REDNECK LIMITED WARRANTY AND DISCLAIMER

 

Redneck Engineering, 107 Nix Rd., Liberty, South Carolina, 29657 (hereinafter “Redneck”) warrants (to the original owner) for a period of Tweleve (12) months from the date of initial retail purchase from an authorized Redneck motorcycle dealer that each new 2006 Redneck motorcycle shall be free, under normal use and maintenance, from any defect in material and workmanship subject to the following CONDITIONS, EXCLUSIONS, OBLIGATIONS, and LIMITATIONS:

 

1.     EXCLUSIONS. The following are specifically excluded from the terms and provisions of this warranty:

(a)   Any Redneck motorcycle engaged in competitive racing or related use.

(b)  Any Redneck motorcycle utilized for rental purposes.

(c)   Any optional extended warranties that may purchased .

(d)  Any warranty made by a Redneck motorcycle component manufacturer.

 

2. COVERAGE. Redneck shall, at its discretion, remedy or replace any material or workmanship found to be defective by Redneck within the twelve (12) month warranty term without charge for parts or labor at any authorized Redneck dealer. Under certain conditions Redneck may authorize certain service work to be performed by authorized Redneck dealers after the expiration of the warranty term. Contact Redneck for further information that may be applicable to your motorcycle.

 

3.  OWNER’S OBLIGATIONS. The following obligations must be fulfilled by owner to obtain performance of any warranty obligation and maintain the validity of the Redneck limited warranty:

(a)   Owner must follow normal use and prescribed maintenance as set forth in the Redneck Owner’s Tips.

(b)  Owner must deliver the motorcycle to an authorized Redneck dealer or equally qualified service facility for inspection, maintenance services, and adjustments according to the Redneck Owner’s Tips and component manufacturers’ instructions. The inspection, maintenance services, and adjustments are to be performed at owner’s expense.

(c)   Prior to obtaining performance under this limited warranty Owner must notify Redneck in writing to the attention of [President] at the address above or via email to redneck@redneckenginuity.com and provide the following information: (i) Motorcycle owner’s name and address; (ii) Motorcycle’s identification number; and (iii.) a description of the problem with .the motorcycle.

(d)  Prior to obtaining performance under this limited warranty Owner must present a copy of this Limited Warranty and Disclaimer or other proof of initial retail purchase date to an authorized Redneck dealer at the time warranty repairs are performed on the motorcycle.

(e)   Prior to seeking any legal remedies in a court, the Owner agrees to submit any controversy with Redneck to non-binding, informal conciliation/mediation first pursuant to the [Better Business Bureau (“BBB”) Care Program or other eligible organization], and then, if conciliation/mediation does not result in a resolution, Owner agrees to binding arbitration to be administered and governed by [the BBB Rules of Arbitration (Binding) or other organization’s rules or ad hoc] before one arbitrator and subject to the following: (i) any decision of or award by the arbitrator shall be final and binding; (ii) judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof; (iii) the arbitrator shall not have the authority to award specific performance, exemplary or punitive damages, incidental or consequential damages, or attorney's fees; and (iv) this provision to arbitrate shall be specifically enforceable pursuant to the Federal Arbitration Act (9 U.S.C. §§ 1 -16). If you choose to pursue other rights not created by the Magnuson-Moss Warranty-Federal Trade Commission Improvement Act, that Act does not require you to submit your warranty claims to informal non-binding, informal conciliation/mediation. 4.  LIMITATIONS. This warranty shall not apply to or include any of the following:

(a)   Repair or replacement required as a result of (i) accident, (ii) misuse or neglect, (iii) lack of reasonable and proper maintenance, (iv) repairs improperly performed or replacements improperly installed, (v) use of replacement parts or accessories not conforming to Redneck specifications which adversely affect performance and/or durability, (vi) alterations or modifications not recommended or approved in writing by Redneck, (vii) unauthorized service, and/or (viii) wear and deterioration occasioned by the use of the motorcycle.

(b)  Routine maintenance, services and adjustments.  These include, but are not limited to, service of (i) bolts and fasteners, (ii) engine tuning , (iii) pipes bluing, (iv) clutches, (v) belts, (vi) gaskets, and/or (vii) seals.

 

5.  LIMITED LIABILITY.

(a)   The liability of Redneck under the twelve (12) month warranty is limited solely to the remedying of defects in materials or workmanship by an authorized Redneck motorcycle dealer at its place of business during customary business hours. This warranty does not cover inconvenience or loss of use of the motorcycle or transportation of the motorcycle to or from the Redneck dealer. REDNECK SHALL NOT BE LIABLE FOR ANY OTHER EXPENSE, FEE, COST, LOSS, OR DAMAGE, WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY, ARISING IN CONNECTION WITH THE SALE OR USE OF OR INABILTY TO USE THE REDNECK ENGINEERING MOTORCYCLE FOR ANY PURPOSE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

(b)  NO EXPRESS WARRANTY IS GIVEN BY REDNECK WITH RESPECT TO THE REDNECK MOTORCYCLE EXCEPT AS SPECIFICALLY SET FORTH HEREIN.

(c)   ANY WARRANTY IMPLIED BY LAW, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS EXPRESSLY LIMITED TO THE SIX (6) MONTH WARRANTY TERM SET FOR HEREIN. THE FOREGOING STATEMENTS OF WARRANTY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER REMEDIES. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

(d)  No dealer or other person is authorized to modify this Redneck Limited Motorcycle Warranty.

 

6.  LEGAL RIGHTS. THIS WARRANTY GIVES YOU SPECIFIC RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.

REDNECK OWNER’S TIPS

(The care and feeding of your Redneck Rocket)

 

THIS MOTORCYCLE HAS BEEN MADE FOR USE IN A REASONABLE AND PRUDENT MANNER BY HIGHLY QUALIFIED OPERATORS AND AS A VEHICLE ONLY. ALWAYS FOLLOW SAFE OPERATING AND MAINTENANCE PRACTICES.

 

ALWAYS FOLLOW INSTRUCTIONS AND WARNINGS TO AVOID DAMAGE TO YOUR MOTORCYCLE OR INJURY TO YOURSELF AND OTHERS. IF YOU DON’T KNOW HOW TO DO SOMETHING, DON’T DO IT. IF YOU DON’T KNOW HOW TO CARE FOR AND FEED YOUR REDNECK ROCKET, ASK US HOW OR HAVE A QUALIFIED TECHNICIAN OR EXPERIENCED MECHANIC DO IT.

 

BREAK-IN:  Follow the break in procedures provided by the engine manufacturer.  Enrichner (choke) should be used sparingly to avoid fouling spark plugs and bluing pipes.  Let the engine warm until head is hot to the touch.  Avoid lugging engine, fast starts, and high speeds for the first three hundred miles.

 

SERVICING: Change engine oil and filter every 50 miles (this was initially completed at the conclusion of our test ride/inspection procedure). Every 300 to 500 miles, have an authorized Redneck dealer or equally qualified service facility in your area go over your bike for loose fasteners, adjustments, maintenance and serving. Have the facility inspect and complete the following:

                Change engine oil filter

                Change transmission fluid and primary (if applicable)

                Check brake fluid

                Remove and clean gas tank filter screen

                Check/adjust clutch, axle adjustment, front rear axle nuts, triple tree bolts, and steering

                 Stem, engine mounting bolts, top engine mounts, and other fasteners.  Any loose bolts, mounts or fasteners should be taken out, loctite applied, and the bolts, mount and/or fasteners should be properly tightened and the loctite allowed to set-up overnight.

 

Always use replacement parts, accessories, and lubricants that conform to Redneck recommended or equivalent specifications of the original component manufacturer.

 

GAS: Only fill gas tank to within one inch of bottom of gas cap bung. Do not fill oil tank above vent or return tubes. Use premium-unleaded fuel with an octane rating of 92 or higher.

 

BATTERIES: High output batteries charge slowly so if you don’t ride at least 30 minutes without stopping you are going to drain it down.  Periodically charge with battery tender supplied or equivalent.

 

ELECTRICAL SYSTEM: Your electrical system/wiring harness is very simple and is hidden in the frame of your bike.  There is a main 30 amp fuse down by the battery (under transmission) and two 15 amp fuses under your seat (one for lights, one for ignition).

 

If your head light burns out; access bulb and plug in other lead until you find a replacement.

 

Spark plugs for Rev-tech 88” & 100” engines are the same as H-D Twin Cam.

 

FASTNERS: Pay attention to the tightness of all fasteners (especially engine mounts).  Prolonged use with loose fasteners causes extra vibration and like cancer can spread to other areas subjecting them to excessive stress. Stress may cause damage to your motorcycle or injury to yourself.

 

DISPUTE MECHANISMS: If you want to bitch about your REDNECK ROCKET we want to hear from you. In order to resolve any problems you may have regarding your REDNECK ROCKET, Redneck asks that you complete the following:

 

1) notify Redneck in writing to the attention of [President] at Redneck Engineering, 107 Nix Rd., Liberty, South Carolina, 29657 or via email to redneck@redneckenginuity.com and provide the following information: (i) Motorcycle owner’s name, address, and phone number; (ii) Motorcycle’s identification number; and (iii.) a description of the problem with .the motorcycle;

2) if after notifying Redneck your problem is unresolved, submit your complaint to informal dispute settlement procedure by contacting the Better Business Bureau (“BBB”) at

(iii) The make, model and year of your motorcycle;

(iv) A description of the problem with your motorcycle; and

(v)  Your desired outcome.

3) if the informal, non-binding conciliation/mediation does not result in a resolution, you have agreed to submit your dispute with Redneck to binding arbitration to be administered and governed by the BBB Rules of Arbitration (Binding).

 

You must file your complaint with the BBB within the six (6) month warranty period, or, in any event, no later than one (1) year from the date of initial retail purchase from an authorized Redneck motorcycle dealer.

 

We don’t like lawyers either. We will attempt to address your problems personally and directly. We will make every effort to decide quickly to what extent we can satisfy you. If we can’t come to a resolution, Redneck will cooperate with the BBB to fairly and expeditiously resolve any dispute you may have with us over your REDNECK ROCKET.

 

REMEMBER: Owning a REDNECK ROCKET puts you in a special class. Like an exotic car it requires special care and maintenance.  Stay in tune with your bike, learn its personality and as you clean and polish watch for indications of loose fasteners and items out of adjustment.  Keep up on regular maintenance and you will enjoy your ride.
